Suzy's Case — Immigration Offence — Police Report

Charge:  Enter Canada Without Minister's Consent, Immigration Act, s. 95

Police Report:  On the 25th of January 2000, the Toronto Police Force executed a search warrant of a premise known as B****, located at 3** Bayley Street West in Toronto. At this time, the Accused was located inside the premise with a male client. She was arrested for being an inmate of a common bawdy house, and advised of her rights to counsel. The Accused was transported to 14 Division, and charged accordingly.

The subject was issued with a conditional deportation order on March 28th, 1993. This order became effective on September 15th, 1994, and her departure was confirmed on August 11th, 1998. The subject has failed to get the Minister's Consent to return to Canada, thereby committing the offence contrary to Section 95 of the Immigration Act.

On the 26th of January 2000, this matter was subsequently referred to the R.C.M.P. who had initiated the investigation.

On the 27th of January 2000, members of the R.C.M.P. attended the Canada Immigration Detention Centre where the subject was being detained. She was briefly interviewed and advised of the nature of the investigation. She was placed under arrest for:  Enter Canada Without the Consent of the Minister, contrary to Section 95 of the Immigration Act. The subject was given the Charter Notice, all applicable cautions, warnings, rights to counsel, and legal aid information, all of which she stated she understood. She was also fingerprinted and photographed, then transported to Brampton Provincial Court for the purposes of a bail hearing.
