Stan's Case — Sexual Assault — Plea to Assault Client: Stan C., Accused Background: Stan and Julie had separated but lived in the same house. When Julie found a full-time boyfriend, it became crowded. In one unfortunate incident, Stan pinned Julie under a blanket, and then masturbated on the blanket. Goals: Stan was concerned about going to jail, being convicted, and being placed on the sex offender registry. He wanted to avoid all three, if possible. Strategy: At our first meeting, Stan explained that Julie would make a great witness against him and that he didn't stand a chance at trial (when I saw Julie's DVD statement, I agreed). After a series of discussions with the Crown, I managed to convince the Crown to accept a guilty plea to the simple assaults. Results: At the sentencing hearing, Stan made a heart-felt apology. I made oral and written submissions seeking a conditional discharge. The Judge agreed. Stan avoided jail, a conviction, and the sex-offender registry. READ STAN'S IN-COURT APOLOGY |
