Simon's Case — Criminal Harassment — Police Report Client: Simon M., Accused Police Report: *** VICTIM #1 *** The victim in the matter is the Vice President of Big Truck Line situated at 101 Speedy Street in Toronto. This victim lives with his family in the City of Oakville. The accused was terminated from Big Truck Line this past January after there were several thefts of cargo skids. On April 11, 2005, the victim exited his home in Oakville. The victim noticed that his mother-in-law's car, which was parked next to his in the driveway, had a flat tire. The victim left for work in his Pontiac Grand Am and discovered that his tire pressure was low. The victim attended a tire repair centre, and was advised that all four of his tires had sidewall punctures. The holes in the tires were small enough to go unnoticed for approximately 24 hours. The victim replaced these tires at a cost of $728.64. The victim learned that his mother-in-law also had to have 2 tires replaced for the same reason at a cost of $362.25. On April 22, 2005, the victim drove his wife's car to work as his was in a shop for an unrelated reason. On his way home this day, he stopped at Tim Horton's approximately 200 metres north of his business on Speedy Street. He then drove home. On April 23, 2005, the victim awoke to find 2 flat tires on his wife's car, both with sidewall punctures of identical nature to the others. The cost to replace these tires was $724.50. After these incidents, and identical occurrences to 2 other executives at the company, the victim and his family became fearful. So much so, that the company hired a private investigation company, called P.I. Firm, to not only find the culprit, but to protect them as well. On May 10, 2005, at around 4:30 p.m., the victim parked his car at Tim Horton's on Speedy Street, as P.I. Firm staff conducted surveillance. When the victim did this, he entered the store to get a coffee. The accused was observed parked in an area of the parking lot where he had set-up observations on Big Truck Line just down the road. The accused approached the victim's car and pulled out a 5-inch awl and punctured both tires on the passenger side. Part of this event was captured on video. The accused hid behind a van and a dumpster until the victim left the area. The victim was notified by P.I. Firm that his tires had been punctured. The cost to replace these tires with used ones cost $90. On May 11, 2005, in the afternoon, the victim again attended the same Tim Horton's. The accused was parked in a spot where he could observe the parking lot of Big Truck Line. The accused again punctured one of his tires with an awl. This entire event was recorded on video. The tire was replaced at a cost of $45. On May 16, 2005, in the afternoon, the victim attended Tim Horton's on Speedy Street. The accused was again parked in a location where he was observing the front of Big Truck Lines. The accused was oblivious to several P.I. investigators and 2 plain-clothes police officers. When the victim parked outside Tim Horton's, the accused exited his vehicle and punctured another tire. The accused was arrested by police as he was returning to his vehicle. The accused had the awl in his left pocket. This event was recorded on video. This episode will cost around $45. The accused was read his rights and transported to 23 Division for further investigation. He was charged accordingly, and held for a show-cause hearing. Total loss to this victim and his family is approximately $2245.39. As a result of this investigation, it was learned that the accused did not previously know where the victim lived. The only way to find that out was to have followed him home. The victim and his family have been living in fear for over a month, and have changed their daily habits. Not only did the accused puncture the tires of the victim, but he did the same to family members. Although at a distance of around 200 metres, there is no question that the accused was able to monitor the movements of people working at Big Truck Line. *** VICTIM #2 *** The victim in this matter is the President of Big Truck Line situated at 101 Speedy Street in Toronto. This victim lives with his family outside of Toronto. The accused, was terminated from Big Truck Line this past January after there were several thefts of cargo skids. On April 18, 2005, the victim arrived at work, and parked his car in front of a large window where he sits. This is an area of high visibility which would make it impossible for anyone to tamper with his car. The victim's car, a 2005 Cadillac, was in perfect condition at that time. At approximately 12:30 p.m., the victim left his office and went to the Auto Mall. It is believed that the accused followed him from this location to the mall. After returning to work, the victim noticed that his driver side was flat. He had a tire repair company replace that tire with his spare. The next morning, the victim discovered that, in fact, all of his tires had a small sidewall puncture, which rendered the tires useless. The cost of replacing those tires cost the victim $1278.98. On April 20, 2005, the victim's company contacted a private investigation firm called P.I. Firm. The company was very concerned for the safety and well-being of 3 executives who were the victims of several mischiefs to tires on their personal cars. All of these executives also expressed fear and concern for their family members because the occurrences were not just limited to them. On April 26, 2005, the victim left his company at 5:30 p.m. At this time, the victim was under surveillance by P.I. Firm staff. As the victim drove towards the Queensway, he noticed a car following him. The victim turned right onto Queensway and made several lane changes, one which was done last second onto Drag Road, in order to shake the vehicle tailing him. At Drag Road, south of the QEW, the victim stopped for a red light. The accused had no choice but to pull by the victim who recognized him. As the victim continued down Drag Road, he received a phone call from P.I. who advised him that he was being followed. The victim was told to pull into a plaza until an investigator caught up to escort him home. The victim abruptly pulled into the parking lot just north of Longshore, and the accused continued by. The victim was then escorted home. On May 10, 2005, the victim left his work in his car which was in perfect order. He went to a restaurant on the Queensway, where he parked his car. It is believed that the accused followed him from Speedy Street to this location. The victim returned to work, and at around 5 p.m., he noticed his tires were going flat. Upon examination of these tires, it was discovered that all four tires had sidewall punctures identical to the previous occurrence to him and the other executives. The tires were replaced again at the cost of $1278.98. On Monday, May 16, 2005, P.I. Firm investigators and 2 plain-clothes police officers set up observations on the accused at Tim Horton's on Speedy Street. The accused was parked facing Big Truck Line, 200 metres away. The accused was watching the front entrance of that company. Another Big Truck Line executive pulled into the parking lot and entered the shop. The accused exited his vehicle quickly and punctured a tire on this vehicle. The accused was immediately arrested and the awl was seized from his pocket. The accused was read his rights and transported to 23 Division for further investigation. He was charged accordingly, and held for a show-cause hearing. Total loss to this victim and his family is approximately $2557.96. It is believed that the accused has set-up in the same location at the Tim Horton's and has monitored the executive of Big Truck Line for over a month. The victim and his family have been living in fear since these events started, and have changed their daily habits. Not only did the accused puncture the tires of the victim, but he did the same to co-workers. This victim expressed great fear in being followed by the accused. *** VICTIM #3 *** The victim in this matter is an executive of Big Truck Lines situated at 101 Speedy Street in Toronto. This victim lives with his family in the city of Mississauga. The accused was terminated from Big Truck Line this past January after there were several thefts of cargo skids. On April 11, 2005, the victim exited his home in Mississauga and discovered that all 4 tires on his Porsche had been punctured causing a slow leak. The victim then drove his fiance's car to work, and discovered that one of her tires had been punctured as well. The holes in the tires were small enough to go unnoticed for approximately 24 hours. The victim had to replace these tires as there were sidewall punctures, at a cost of $361.39. On April 21, 2005, the victim noticed that a tire on his Corvette had also been punctured in an identical fashion. This was repaired and the victim went home. Upon arrival home, the victim discovered that his fiance's car had a tire punctured, and called for a repair company to attend. The cost of replacement for her car was $325.68. The victim also had his Porsche's tires replaced at a cost of $639.40. After these incidents, and identical occurrences to 2 other executives at the company, the victim and his family became fearful. So much so, that the company hired a private investigation company called P.I. Firm, to not only find the culprit, but to protect them as well. On May 3, 2005, the victim discovered another puncture hole on a tire already replaced. This was repaired at a cost of $100. On May 10, 2005, the victim had another 2 tires punctured on his Pontiac. Once again, they were fixed at a cost of $333.52. When the victim arrived home in Mississauga, he found his Porsche had punctured tires again. On May 16, 2005, in the afternoon, the victim attended Tim Horton's on Speedy Street. The accused, was again, parked in a location where he was observing the front of Big Truck Line. The accused was oblivious to several P.I. Firm investigators and 2 plain-clothes police officers. When another executive parked outside Tim Horton's, the accused exited his vehicle and punctured his tires. The accused was arrested by police as he was returning to his vehicle. The accused had the awl in his left pocket. This event was recorded on video. The accused was read his rights, and transported to 23 Division for further investigation. He was charged accordingly, and held for a show-cause hearing. Total loss to this victim and his family is approximately $2204.75. As a result of investigation, it was learned that the accused did not previously know where this victim lived. The only way to find that out was to have followed him home. The victim and his family have been living in fear for over a month, and have changed their daily habits. Not only did the accused puncture the tires of the victim, but he did the same to his family members. Although at a distance of around 200 metres, there is no question that the accused was able to monitor the movements of people working at Big Truck Line. |
