Silvio's Case — Assault & Weapons — Dismissed

Client:  Silvio, Accused
Complainants:  Libby, Stranger on the street
Charges:  assault with weapon, weapons dangerous, carry concealed weapon

Background:  "Good night," Silvio said to his friends as he started walking home. It wasn't long before he was accosted by a female and her friends. They began ribbing Silvio about his appearance. He stood up to them. They surrounded him in a semi-circle. Silvio became fearful, and pulled out a penknife that was attached to his key chain. Silvio's friends noticed that something was wrong, and ran towards him. By the time they arrived, the persons who had accosted Silvio had told the police their version of the events. Without questioning Silvio or his friends, the police immediately arrested Silvio for assault with weapon, weapons dangerous, and carry concealed weapon. He was held for a bail hearing, and was released the next day on strict conditions.

Goals:  When Silvio came to see me, he explained that he had acted in self-defence, and that he wanted to defeat all charges.

Strategy:  Not getting much sympathy from the Crown, we scheduled the trial, and prepared for battle. The trial began almost 12 months later. Everyone testified.

Results:  In the end, the Judge found that Silvio had acted out of fear and in self-defence. She dismissed all charges.
