Seth's Case — Impaired Driving & Over 80 — Police Report

Charge #1 — Unlawfully in a Dwelling House:   On 18 September 2003, shortly after arrival at 141 McGrath Lane re unwanted male call, I was informed by Cst. J. Wilson #241 the complainant, Tammy Maclean, DOB 21 September 1976, gave Cst. Wilson a statement which contained the following:  Seth W. entered complainant's house at 141 McGrath Lane on 18 September 2003 at approximately 2:00 a.m. through unlocked patio door; Seth W. was asked repeatedly by complainant what he was doing there and repeatedly replied, "You don't know"; Seth W. offered no other explanation for his presence; Seth W. did not leave immediately when directed to do so by complainant and upon leaving was seen looking into windows; Prior to this event the complainant knew Seth W. as an acquaintance only as a patron of the C*** & F*** Pub. Complainant states Seth W. was seeking more than platonic relationship at this time and she was not interested.

Charge #2 — Operate a Motor Vehicle Over 80 mg:   On 18 September 2003, I was dispatched to speak with complainant Tammy Maclean, DOB 21 September 1976, re unwanted male. Upon arrival, suspect was not present but identified by complainant as Seth W. who came into her premise intoxicated and uninvited (141 McGrath Lane). As I spoke to complainant she pointed out Seth W.'s Blue Explorer heading towards me westbound on McGrath Lane. I stopped Seth W.'s vehicle and he identified himself with a valid Ontario Driver's Licence. I noticed a strong smell of alcoholic beverage from his breath and his eyes were bloodshot. Seth W. registered an "F" on roadside screening device and registered readings of .270 mg and .273 mg as recorded by Cst. L. Davis #230.
