Rosa's case— Sexual Assault (domestic) — Police ReportClient: Rosa, Complainant Police Report: The Accused is a 26-year-old male who was once involved in a boyfriend/girlfriend relationship with the 19-year-old female victim. This relationship was terminated by the victim some 12 months ago. There has been no contact between the two save on one occasion when the Accused called the victim to tell her to come to his place and get some belongings she had left there. The victim did not go. On Saturday, August 10, 2001, the victim made arrangements to meet her girlfriend at the Yorkdale Mall. The victim had prepared résumés to hand out to the various stores in an effort to secure a summer time job. The victim was going about her business when she was approached by the Accused. The Accused tried to get the victim to leave with him and she declined. The Accused grabbed her purse and walked out of the mall to his vehicle. The victim followed the Accused, demanding her purse. Out in the parking lot, the Accused asked the victim to get into his vehicle. She declined. The Accused locked her purse in his vehicle and told her she would only get it back if she got into the car. They argued outside the car and this alerted two mall security officers patrolling the parking lots. The security officers interceded and demanded the Accused return the victim's property. He complied and the security officers drove off. Once they left the area, the Accused forced the victim into his vehicle and drove off with her, not letting her leave. The victim bit the Accused twice on the right wrist in an effort to free herself. The Accused drove north on City Street and pulled off into the common driveway between 3330 City Street and 3360 City Street. As he was driving, he fondled the victim's breasts. He parked the vehicle some distance from 3330 City Street with the vehicle facing in an east direction. He removed the victim's t-shirt and grabbed her purse and exited the vehicle. The victim clad in a pair of slacks and her brassiere was then dragged from the vehicle. The purse was thrown to the ground spilling some of the contents. The Accused forced the victim's head and shoulders into the driver's seat area and was now in a kneeling position. The Accused pulled her slacks and panties down to her knees and then had sexual intercourse from behind. The victim struggled with the Accused the entire time. The Accused scraped the knuckles on his right hand on the ground during this time. Once the act was completed, the Accused grabbed the victim's purse and pushed her away from the vehicle. He got into his 1994 blue 4-door Honda Accord bearing Ontario marker RTM 385 and drove back toward City Street, leaving the victim half undressed. The victim picked up a combination lock that fell from her purse and threw it at the Accused's vehicle, striking it. The Accused parked his vehicle near City Street and then walked back to the victim. He grabbed the victim and escorted her to the vehicle at which time he forced her back inside. The Accused then digitally penetrated the victim and tried to force her to fellate him. She managed to get out of the vehicle with her t-shirt and was again grabbed by the Accused who was trying to force her back into the driver's side of the car. The victim was screaming for help, which was heard by three men in a vehicle on City Street. The men saw the Accused trying to force the victim into the car and stopped to assist her. The victim told the men to call the police as she had been raped. The Accused was told to unhand the victim. He complied, and the citizens used their cellular telephone to call for the police. Police attended and entered into an investigation. They observed two bite marks on the Accused's right wrist and fresh scrapes to his knuckles on the same hand. The victim was attended to by the Department of Ambulance Services, and the Accused was arrested at the scene. The Accused denied sexually assaulting the victim and indicated he was the one who was assaulted by the victim. He was taken to 32 Division where he was investigated and charged accordingly. Injuries to Victim: Bruising and scrapes to her arms, legs. Complained of soreness to her arms. Examined at Scarborough Grace Hospital and released. Injuries to Accused: Noticeable bite marks to his right wrist. Scrapes to all knuckles on right hand. No treatment required. |
