Riley's Case — 419 fraud — arrest statement21 September 2005 To: York Regional Police Service; any other police
officer I, Riley F., hereby confirm that I have instructed my counsel, Craig Penney, that I do not wish to be interviewed or questioned by the police, that I do not wish to make any statement, that I do not wish to give any other evidence (be it handwriting samples, documents, or receipts), and that I do not wish to consent to the search of my property or documents. I have instructed Mr. Penney to draw up this document so that any officer who attempts to take a statement from me, obtain my consent to search, or otherwise attempts to obtain evidence can be informed of my wishes. If any statement, other evidence, or consent is obtained from me, it will not be free or voluntary. If I am arrested, however, I do wish to cooperate by providing information
you require in order to release me — my name, proper identification,
and home address. I also wish to cooperate by submitting to your authority
to search me incident to my arrest and by providing my fingerprints and
photographs as required by the Identification of Criminals Act.
I do not wish to provide any more information or cooperation other than
that which is absolutely necessary for those purposes. I also wish to speak immediately with Mr. Penney. Please allow me access to a telephone so that I may contact Mr. Penney. If Mr. Penney is not immediately available, I do not wish to speak with duty counsel. Please hold off questioning me until I have had an opportunity to consult with Mr. Penney. Signed: Mr. Riley F. |
