Rick's Case — Sexual Interference — Police Report

Client:  Rick, Accused
Complainant:  Sam, friend of Rick's son
Charges:  Invitation to Sexual Touching and Sexual Interference

Police Report:  On the 21st of October 1995, the complainant, Sam, age 13 years, attended at a sleepover birthday party at 3121 Harlow Drive, Oakville. The accused, Rick K., resides at this address.

On October 22, 1995, between the hours of 12:00 a.m. and 6:00 a.m., the accused went downstairs to where the boys were laying with sleeping bags and blankets. The accused requested that the boys settle down. The boys pretended to be sleeping. The accused, using his hand, stroked the complainant's right leg and buttock. He then went upstairs. 

Approximately one hour later, he returned downstairs and again he stroked the complainant's thighs and buttocks. The complainant said nothing but felt uncomfortable. The accused went back upstairs. 

A short time later, he went back downstairs and sat on a mattress close to the complainant. He was on the mattress for approximately 10 minutes. The complainant was pretending to be asleep. Rick K. began to stroke the complainant's hair and face and lips. He then took the complainant's hand and placed it between Rick K.'s legs in his groin area. The complainant pulled his hand away, and pretended he was sleeping.

On October 22, 1995, the complainant advised his mother, who then attended at the police station with the complainant to make a report. Subsequently, on November 2nd, 1995, the Accused was arrested, read rights to counsel and caution, and released on a Form 11.
