Philip's 1st Case — Weapons & Theft — Police ReportClient: Philip, Accused Youth Charges: Theft Under $5000; Possession of Weapons Dangerous; Assault with a Weapon; Carrying a Concealed Weapon; Uttering Threats Police Report: At approximately 1918 hrs on 2 October 2002, police arrived on scene and found all 4 victims, as well as Gary R. on Vanderbilt Road, just North of Curtis Avenue East. At this time, Philip K. was observed running away between 2 houses onto Harris Avenue. Police spoke to all 5 youths regarding what had occurred. At 1930 hrs, police had arrested the accused for assault with a weapon, uttering threats, theft under, weapons dangerous and carrying a concealed weapon. Gary R. was searched and then placed in the rear of a marked police cruiser. The accused Gary R. was read his rights to counsel and cautioned. He said that he understood his rights and that he wished to speak to his parents. The accused was then transported to 2 District Headquarters where he was viewed in the booking room by Sgt. Lewis. Property was removed from the accused, and placed in Locker #F1. The accused was then located in Cell F1. At 2126 hrs, a message was left with duty counsel. At this time, Gary R.'s parents had arrived at the front desk of 2 District Headquarters. They were advised of the situation. At 2135 hrs, duty counsel called and spoke with the accused ending the call at 2138 hrs. The accused was then re-lodged in Cell F1. The accused was returned his property at 2347 hrs, and brought to the front desk. Sgt. Weyt #451 released Gary R. on a form 10 and 11.1. A notice of parent was issued to the mother of the accused. All four victims had attended to 2 District Headquarters and provided statements to the police. Attempts were made to contact Philip K., however, there was no answer on the telephone. **** Count Synopsis **** THEFT UNDER $5000; POSSESSION OF WEAPONS DANGEROUS; ASSAULT WITH A WEAPON; CARRYING A CONCEALED WEAPON; UTTERING THREATS On 2 October 2002 victims one, two, three, and four were playing road hockey on Vanderbilt Road in Richmond Hill. Victim one had parked his vehicle on Vanderbilt Road facing Northbound, just North of Curtis Avenue East. Victim one did have his driver's side window rolled down. At approximately 1900 hrs, the accused Gary R. was observed leaning through the driver's side window of victim one's vehicle, grabbing victim one's backpack which was on the front passenger seat. Victim one saw this occurring and along with victims two, three and four began to chase the accused as well as Philip K., who was standing right beside the accused Gary R. at this time. A verbal argument ensued between the accused Gary R., the suspect and all four victims. Gary R. and Philip K. then walked away. Fifteen minutes later, Gary R. along with Philip K. had returned back to the scene. Gary R. was holding a broken broomstick handle. Philip K. was holding an iron rod. They approached all four victims. Gary R., while holding the broken broomstick, told victims one, three and four that he had a gun, and pointed to his pant leg where all three victims observed something underneath. Gary R. then threatened victim one, three and four that he was going to shoot them, but he couldn't, at their present location, due to too many witnesses. Gary R. then slapped victim two, three, and four in the face, calling them on to fight. |
