Nathan's Case — Child Pornography — Police Report Client: Nathan, Accused Police Report: York Regional Police received a package from the National Child Exploitation Coordination Centre, located in Ottawa, Ontario, regarding targets in York Region who had purchased access to child pornography websites over the internet. The database revealed that the suspect made a purchase to access a child pornography site using his credit card. The purchase was made using credit card number 4164-1022-6641-0226 on 28 May 2003 to the website http://www.***.com. The database indicates that the purchase was registered as "approved" and the suspect used an e-mail address of nathan@***.com. The suspect's driver's licence history reveals that he currently resides at 54 Lara Drive, in the town of Richmond Hill. Background checks indicate that the suspect has no previous criminal record and no outstanding charges. A search conducted on the internet revealed that the suspect is a teacher with ***. On 14 February 2005, officers checked the suspect's residence and noted a vehicle bearing Ontario licence plate number RTM 385 parked in the driveway. The vehicle is registered to the suspect and his father at 54 Lara Drive, Richmond Hill. The investigation is continuing. SUPPLEMENTARY REPORT: On 3 March 2005, a Criminal Code Search Warrant was executed at the Bank of Montreal on Yellow Street in the city of Toronto, for the credit card records of Mr. Nathan L. The results for the search warrant on Mastercard number 4164-1022-6641-0226 indicate that two purchases were made between 28 and 29 of May 2003. The charges were to a company for the amount of $75.33 CDN. This information will be used towards gaining a search warrant on the residence of Mr. Nathan L. On 4 March 2005, a uniformed officer was asked to attend in the area of 54 Lara Drive, in the town of Richmond Hill, to observe any vehicles in the driveway or movement around the house. The uniform officer noted the same licence plate RTM 385 parked in the driveway. Shortly after the uniform car left the area the same vehicle left the driveway of the residence. The uniform officer caused the vehicle to be stopped due to a loud muffler and extremely dark tint on the windows. The driver of the vehicle identified himself with a valid Ontario driver's licence as Nathan L. No tickets were given for any traffic infractions. On 10 March 2005, a Criminal Code warrant was executed at the suspect's residence located at 54 Lara Drive in the town of Richmond Hill. The warrant was executed upon the suspect's parents. The suspect had earlier flown to Calgary. A precursory search of the family computer did not locate any images of child pornography. A quantity of discs, VHS tapes, and floppies, digital camera, and documents were seized from the residence pending a forensic search. The property is currently being stored at Head Quarters pending an examination. COUNT 1 — Possession of Child Pornography, Section 163.1-4 On 20 May 2003, the accused purchased access to a website. www.***.com that contained images of child pornography using credit card number 4164-1022-6641-0226. On 10 March 2005, a Criminal Code search warrant was executed at the accused's residence located at 54 Lara Drive in the town of Richmond Hill. A search of the media that was seized revealed images of child pornography. On 23 March 2005, the accused attended 1 District where he was arrested and instructed as to his right to counsel and cautioned. He was afforded a telephone call to his counsel of choice and was interviewed on video tape. The accused was held for a show-cause hearing for 23 March 2005. On 23 March 2005, the accused was released on a $5000 Recognizance of Bail (no deposit) with a return date of 12 April 2005. |
