Marlene's Case — Keep Bawdy House — Police Report

Police Report:   On the 6th of February 1997, members of the Vice Unit made inquiries into an advertisement in the Now Magazines Adult Entertainment Classifieds that read:  "Mississauga. Blonde passionate 40 yr old with a warm & tender touch! 272-2***"

Officers were quoted a price of $160 for a session, and directed to place a second call to the service from a public telephone at 125 Dunlyn Street West, Mississauga. Officers placed a second call and were directed to 125 Dunlyn Street West, Mississauga, and given an entry code of 333.

Further investigation with Peel Living revealed that this entry code number at 125 Dunlyn Street West, Mississauga, is assigned to apartment number 12**, the apartment of the Accused, Marlene K. It was further learned at that time that Peel Living had received an anonymous complaint in September 1996, alleging that a tenant there was operating an escort service on the 12th floor, which they had associated to apartment number 12**.

Further investigation of other publications between February and May 1997 revealed that this escort agency, Midnight Sun, to be advertised in various publications, including:  Now Magazine, Eye Magazine, The Toronto Sun, and others.

On the 1st of May 1997, an Officer of the Morality Bureau contacted an advertisement associated to this premises. The Officer was quoted $180 for a "session," and directed again to place a second call from the previously noted location, and subsequently directed to the Accused's apartment.

The Accused immediately wished to collect the fee, and when questioned by the Officer what he could expect, she advised ". . . massage is just if you want it . . . I love oral and I like to be on top for intercourse . . ." The Officer made excuses, paid the Accused a fee for wasting her time, and left the premises.

On the 10th of May 1997, a second Officer of the Morality Bureau contacted the advertisement associated to this premises. The Officer was again directed to a pay phone first to place a second call, and did quote a price of $150 for a full body massage and "lots of fun." The Officer placed the second call as instructed and was directed to the Accused's apartment. Upon arrival, the Accused collected $140 from the Officer, at which point the Officer stated that he hoped that $140 would include intercourse, to which the Accused replied:  "Yes, only I'm on top." The Accused then retrieved a condom from the drawer and advised that it was for his protection and hers. The Officer declined her offer, requested that she dance for him, and then left the premises.

On the 2nd of June 1997, a Criminal Code search warrant was obtained for the premises, deeming it to be a common-bawdy house. At approximately 3:55 p.m., another Officer of the Morality Bureau, having made prior arrangements through the advertised number, attended at the premises after being quoted a price of $180 for the session.

At approximately 4:10 p.m., the warrant was executed at the premises, and the Accused found in the company of the undercover Officer who she advised was her boyfriend. The Accused was placed under arrest, advised of her Right to Counsel, and cautioned.

The undercover Officer advised that he had already paid the Accused the sum of $180 and had been ensured that he would receive sexual acts in exchange for his monies.

The Accused contacted her lawyer from the premises to be transported to 11 Division where she was held for a bail hearing.
