Jason's Case — Criminal Harassment — Dismissed Client: Jason, Accused Police Report: Complainant/victim Lacy Spelling (31 January 1966) and accused Jason C. (4 October 1951) have been together for approximately six years. They resided together for approximately three years. The victim has a 12 year-old daughter, Nancy Spelling from a previous relationship that also resided with them. Victim and accuser's relationship dissolved in January 2004. In February 2004, victim and accused attempted to reconcile and rebuild their relationship. This was unsuccessful. Accused now resides at 52 Better St., Milton. Accused does not know where victim is currently residing. On May 13, 2004 the victim contacted the police to report that the accused was repeatedly following her and contacting her. P.C. V*** cautioned the accused with respect to his behaviour. The accused was advised that any further contact might result in criminal charges. On May 14, 2004, the accused contacted the victim. The accused contacted victim again on June 6, 2004 and September 10, 2004. As a result the accused was arrested on September 11, 2004 for criminal harassment and released on a Promise to Appear and an Undertaking. On September 12, 2004, the victim attended 12 Division to report that the accused was following her again. Victim was southbound on Oldman St. in the Town of Milton at approximately 2:00 p.m. on today's date. Victim observed the accused in the area of Oldman St. and Cartwheel Dr., Milton in his motor vehicle. The accused owns and operates a 2003 Honda Civic 2 door black with Ontario licence plate RTM 385 . The accused was traveling northbound. After the victim saw the accused, she continued southbound on Oldman St. She glanced in her rearview mirror and saw the accused indicate that he was going to make a right hand turn. Victim advised the right hand turn was made at the next available opportunity. This was on Cartwheel Dr., Milton. Victim proceeded to the Lollypop Plaza located at 500 Lollypop Av. Milton. This plaza consists of a number of stores that are side by side. There is one parking lot at the plaza and it is located at the north side. Victim parked in front of the Pet Value store. Her vehicle was facing in a southbound direction toward the store. When victim exited the store she observed the accuser's vehicle parked at the rear of the parking lot. The accused was parked in the north end of the parking lot, just south of Lollypop Ave. Accuser's vehicle was northwest of victim's vehicle. The accuser's vehicle was facing southbound toward the plaza. Victim got back into her store. This store is located beside the Scotiabank. When victim exited the variety store she noticed that the accuser's vehicle had been moved to a different location. He was now parked in front of the Fine Food variety store, facing southbound toward the store. Again, victim could easily identify the person as the accused in his vehicle. Victim walked back to her vehicle and immediately left. She proceeded northbound on Oldman St. Milton. She checked her rearview mirror and noticed the accused following behind her approximately one block. Victim turned right onto Cartwheel Dr. Milton and into the parking lot at 12 Division. Victim last saw the accuser's vehicle at the intersection of Cartwheel Dr. and Oldman St. Milton. While the victim was waiting in the lobby at 12 Division, she observed the accuser's vehicle at the Milton Mall parking lot. It was parked facing toward 12 Division. This parking lot is just north of 12 Division, across the street. Victim was very nervous and crying when she attended 12 Division. She was fearful for her safety and had concerns that the accused would wait outside her mother's residence and follow her mother in an attempt to locate the residence of the victim. Victim also had concerns that the accused may wait outside her daughter's school and follow the school bus to her residence and obtain her current address in this manner. Writer obtained a written statement from victim and completed a risk indicators form. Victim had very serious concerns for her safety. Writer followed victim to her residence for her safety after the statement was complete. The accused attended 12 Division and was arrested by writer. The accused provided an inculpatory statement on video and indicated he did see the victim today at the Lollypop Plaza and that he was at the mall parking lot when the victim was at 12 Division. The accused was subsequently held for a bail hearing September 13, 2004. |
