Jaffe's Case — Sexual Interference — dismissed

Client:  Jaffe, Accused
Complainant:  a person at church
Charges:  Sexual Interference (2x) and Sexual Assault (2x)

Background:  Jaffe was surprised one evening to find the police at his door. He was shocked to learn that he was being arrested for abusing two young boys at church that day. An acquaintance of Jaffe had complained to the police that his son and one other boy had been sexually abused. Jaffe was charged with two counts of sexual interference and two counts of sexual assault.

Goal:  My goal was to have all the charges against Jaffe withdrawn or dismissed. 

Strategy:  The Crown refused to withdraw the charges. My strategy was simple: get to trial, do my best to bring out the truth of what happened, and get all charges dismissed. We had to wait over 8 months to get to trial.

Results:  At trial, I succeeded in having two charges dismissed even before Jaffe had to testify. After Jaffe testified, the Crown conceded that the third charge should also be dismissed. The Crown and I fought over the last charge. The Judge, though, had the final say: charge dismissed.
