Dismissed — Sexual Interference — Police Report

Client:  Jaffe K., Accused
Complainant:  a person at church
Charges:  Sexual Interference (2x) and Sexual Assault (2x)

Police Report:  On the 3rd day of July 1998, the nine-year old victim and his family were attending a religious function at a church located at 1*** Jane Street, Vaughan. During the service, the Accused sat down beside the victim and struck up a conversation about the $10 the victim was holding. The Accused then placed his hand on the victim's inner leg and rubbed it. This made the victim uncomfortable. The victim's father saw the Accused's arm down beside his son but could not see what was happening. The victim got up and moved over and sat beside his father.

The father later observed the Accused moving to another seat between two small boys. The Accused placed his hand on the child's crotch and began rubbing it over his clothes. Upon leaving the church, the father sensed something was wrong with his son and the victim told his father the Accused had been rubbing his leg. At this time, the Accused fled the scene and the victim's father called the police.

The victim and his father then attended York Regional Police, 4 Division Headquarters, where the victim gave a video statement and the father submitted a written statement. The Accused is an acquaintance of the victim's family and was identified. On the 4th of July 1998, at 2:15 a.m., police attended the Accused's residence where the Accused was arrested for sexual assault, cautioned, and read his rights. He was transported to 4 Division Headquarters where he was held for a bail hearing. As it is believed that several other young boys have been assaulted, a three-day hold has been requested for further investigation.
