¶ 1 MS. RICHARDS: Good morning, your honour. Richards, initial B, for the Crown in relation to the indictment for Mr. R. ¶ 2 MR. PENNEY: Good morning, your honour. Penney, initial C. Mr. R. is coming forward. ¶ 3 THE COURT: Yes. ¶ 4 MS. RICHARDS: Your Honour, it is not my intention to go at length in relation to the reasons. Quite frankly, and with all due brevity, the Crown reviewed the matter and is not convinced that there is a reasonable prospect of conviction, and, in view of that, I am asking it be noted that the Crown is not proceeding on the indictment before this Court. ¶ 5 THE COURT: Yes, I was advised that it wouldn't be proceeding today, and I took a look at the notes, and I think you made the right decision. ¶ 6 MS. RICHARDS: I appreciate the Court's comments, and I am glad Your Honour got the materials. They are very thorough. ¶ 7 MR. PENNEY: Thank you. ¶ 8 THE COURT: So ordered. ¶ 8 MS. RICHARDS: That completes the matter that I have carriage of. My colleague has carriage of the next matter, if I may be excused, your honour. ¶ 9 THE COURT: Yes. |
