Hubert's Case — Criminal Harassment — Police Report

Client:   Hubert W., Accused
Complainant:   Hubert's former employer, T*** Health Services
Charge:   Criminal Harassment (repeatedly communicating)

Police Report:   The accused before the courts had worked at T*** Health Services located at 4** Bay Street in the city of Toronto for approximately 7 years. In May of 2001 he was terminated as an employee.

The victims in this matter, M.R., S.A., Z.M., E.S., S.H., I.W. and J.H., all worked with the accused during his employment.

The accused was convinced that his termination was the fault of his co-workers and he grew increasingly angry because of what he believed to be unfair treatment.

After his termination the accused began calling the business of T*** Health Services and leaving messages to his now ex-coworkers. These messages were very offensive in nature and used racial slurs and profanities.

Examples of the messages the accused left are as follows:  

1) 2002-09-02:  "Yo, Yo, f**k you ugly n****r. Yo, f**k you ugly n****r. Go to hell ugly n****r. F**k you ugly n****r b**ch." (The complainant is a female.)

2) 2002-09-15:  "F**k you Egyptian bastard, stupid Egyptian mother f****r. You are ugly, you are stupid. F**k you stupid. Go to hell Egyptian mother f****r."

The accused continued to call T*** Health Services up until the 10th of March 2003 leaving over 25 similar messages for his coworkers.

On the 21st of March 2003 the accused was contacted by the police and he attended 52 division. At this time he was arrested, advised of his rights to counsel under the charter, and charged accordingly.
