Fred's Case — Sexual Assault — Police Report

Police Report:  The complainant in this matter, Wendy C., is 16 years old and has been working on occasion for the past 6 months as a model with an agency run out of an apartment at City Street. The operator of this agency is a woman known to Wendy C. as Marion.

On Friday, August 2nd, Year 0, the Victim in this matter attended at the apartment of a woman who acts as her agent to attend a pre-Caribana party for herself and several other models attached to the agency. Included at the party was the Accused man before the Court who was known to the Victim as a videographer. The Victim knew this person by the first name of Johnny.

During the evening, the Victim mingled with the guests and consumed approximately two glasses of wine. Due to the fact that the victim was not used to drinking, the wine affected her quickly and caused her to feel sick and tired. On Saturday, the 3rd of August, Year 0, at approximately 12:30 a.m., the host of the party, Marion T., took the victim into her bedroom and put her to bed to let her sleep off the effects of the alcohol.

The Victim indicates that between 4:00 a.m. and 5:00 a.m. she was startled awake by a man who was on top of her and in the process of having intercourse with her. The male put his hand over her mouth and continued to have sex with her until he was finished and got up and left. This man was known to her as Johnny. The Victim fell back asleep, still suffering from the effects of the alcohol, and got up later in the morning and reported the incident to the owner of the apartment, Marion T.. The Victim was told to forget about it and not to worry, and she then left the apartment at about 10:00 a.m.

Approximately three months later, the Victim found that she was pregnant and advised her mother of the incident, and, with her assistance, an appointment was made at the Morgentaler Clinic on Hillsdale Ave, Toronto, for an abortion.

On the 19th of November, Year 0, the Victim attended the Clinic and spoke with a counsellor and related the incident, and officers attended and took a brief report.

On the 20th of November, Year 0, at approximately 10:30 a.m., the victim again attended the Clinic to have the abortion, and police were notified to attend at the Clinic, but due to the fact that the Victim was being prepared for surgery the officer could not speak with her. After the surgery, the attending officer seized the aborted fetus and the aborted placenta. A control sample of blood from the victim was also taken and all of the evidence was submitted to the Centre for Forensic Sciences.

On the 26th of November, Year 0, the Victim was contacted by the arresting officer and she attended at the station to provide a taped statement of the incident. The Victim attended and related the above information.

As a result of the interview with the Victim, her agent Marion T. was contacted to provide a statement. On Wednesday, the 27th of November, Year 0, a taped interview was conducted and she confirmed the fact that the Victim and the Accused had been present at the party. Through this interview, the proper name of the Accused was found to be Fred G. with a Toronto address.

Several messages were left for the Accused to call the investigating officer, and, as a result of the messages, counsel for him, Craig Penney, called to inquire about the charge. Information was related to counsel and arrangements were made for the Accused to turn himself in.

On Thursday the 2nd of January, Year 1, the Accused, accompanied by his counsel Craig Penney attended 42 Division to be investigated. The Accused at this time was arrested and charged accordingly.
