Evan's Case — Assault and Death Threat — Police Report Client: Evan P., Accused Police Report: The victim and the accused have been married for five years and separated for two months. They have no children, and the accused has a history of verbal abuse toward the victim. The accused has left the residence and the victim resides there alone. She recently had the locks changed in fear that the accused would return home and become violent. On 9 January 2003, the victim was home alone with her mother who is visiting from Mexico. The accused attended the residence and rang the doorbell. He then entered the residence through the basement door. That lock had not been changed. The accused came upstairs and was confronted by the victim at the top of the basement stairs. An argument ensued and the accused shoved the victim in the chest with two hands causing her to fall to one knee. The victim screamed for the accused to leave and the accused went upstairs to the closet where he stored his long guns. He removed a case containing the guns and ammunition and pried it open using a screwdriver. With the gun in hand, the accused advised the victim on several occasions that she and her family would be "sorry." He made inference that he had made arrangements of some sort by phoning Mexico for this purpose. The accused repetitively addressed the victim as a "fat bitch" as he threatened her. The accused then left the residence in his vehicle. The guns were the only property he took. He left his clothing bags at the residence. The victim contacted police via 9-1-1. PC W*** attended and took the report. The victim provided a written statement to police and Domestic Violence Supplementary Report was filed. The victim was advised of contact information for VCARS and the Barrie Women's Shelter. The victim was provided with a safety plan guidebook as well. The accused was placed on CPIC as S.I.P. A zone alert was sent to several agencies. The victim advised she is now fearful for the safety of her family in Mexico. PC W*** sent a message through Interpol to the Mexico City police to check on the well being of the G*** family. PC W*** received a phone call from S/Sgt M*** of the Halton Regional Police who advised that they had located the accused's vehicle at his residence in Burlington. At the time of this report, he advised that they were attempting to locate the accused and would advise if he were arrested. PC W*** received information from Halton Regional Police that the accused was arrested and held at 3 District. PC W*** attended 3 District at 2140 hours and advised the accused of his rights to counsel and caution. He advised that he understood. He was transported to Barrie Police Service and held for bail. The long guns and ammunition were placed in property at Halton Regional Police Service pending a bail hearing. Barrie Police requested interim seizure for firearms as a condition of release. |
