Doug's Case — Sexual Interference — Police Report

Police Report:  The accused is the victim's paternal grandfather. The victim resides with her father at 25 Lemon Drive, in the City of Brampton. At the time of the offence, they resided at 2145 Lime Street, in Mississauga. The victim is 13 years of age.

On July 16, 2006, the victim was at her residence with her cousin Rose Miles and two friends. They were preparing to attend Canada's Wonderland for a concert. It was arranged for the accused to drop them off at the concert.

The victim attended the bathroom area to use the toilet. While there, the accused opened the bathroom door. The victim crossed her hands over her vaginal area in an attempt to conceal her body. The accused stood in front of her victim and pulled her hands away from her vagina and said: "You're cute." He then exited the bathroom.

On August 12, 2006, the victim attended the Special Victims Unit to report the incident to police.

On August 14, 2006, the accused attended Peel Regional Police, 12 Division, where he was arrested for the offence of sexual assault, contrary to section 271 of the Criminal Code of Canada. Due to the age of the victim he was also charged with the offence of sexual interference, contrary to section 151 of the Criminal Code of Canada. He was read his rights to counsel and duty counsel as well as being cautioned, all of which he understood. The accused provided an inculpatory statement to police. He was released on a Form 10 [Promise to Appear] and Form 11.1 [Undertaking to Police Officer].

The victim did not sustain any injury.
