Damian's Case — Assault (domestic) — Withdrawn

Between
Her Majesty the Queen, and
Damian K.

Ontario Court of Justice
Newmarket, Ontario
Judge B. Calvin

Withdrawn:  30 June 2006
(32 paras.)

Charge:

Assault, Criminal Code, ss. 266

Counsel:   D. Miller, Assistant Crown Attorney, Newmarket
Craig Penney, Criminal Defence Lawyer, Toronto

1     MS MILLER:  The first is Damian K.

2     MR. PENNEY:  Yes. Good morning, Your Honour. Penney, initial "C."

3     THE COURT:  Can I see the information, please?

4     MR. PENNEY:  I'll appear on the Designation for the moment, Your Honour, but Mr. K. is outside the body of the Court — in fact, watching my briefcase.

5     THE COURT:  Okay.

6     MR. PENNEY:  My friend has advised me that we are the youngest matter, so essentially we are last on the list. We did set a very quick trial date — I think it is within six weeks of the set date, so ...

7     THE COURT:  No problem, no problem.

8     MR. PENNEY:  ... we're ready and ...

9     THE COURT:  So ready to go if it can't be resolved, yes.

10     MR. PENNEY:  We're ready to go if it can't be resolved, yes.

11     THE COURT:   Okay, no problem.

12     MS MILLER:  I haven't seen the complainant yet...

13     THE COURT:  That's fine.

14     MS MILLER:  ... so, as soon as I have a moment to speak with her, I will know where we are going with that.

15     THE COURT:   No problem.

[REPORTER'S NOTE:  Other matters are dealt with at this time.]

16     THE COURT:  Where are we?

17     MS MILLER:  Your Honour, if we could deal first with the Damian K. matter.

18     MR. PENNEY:  Mr. K., would you come forward, please. Good morning again, Your Honour. Penney, initial "C", for the record, P-E-N-N-E-Y.

19     THE COURT:  What is it that you wish to do?

20     MS MILLER:  This is to be resolved by way of a common-law peace bond.

21     THE COURT:  Thank you. What are the conditions?

22     MS MILLER:  A period of six months, five hundred dollar recognizance, no deposit, no surety, with the condition to keep the peace and be of good behaviour, and not to possess any weapons.

23     THE COURT:  Okay, thank you. Take a seat, sir. Once these are signed, you are free to go.

[REPORTER'S NOTE:  Other matters are dealt with at this time.]

24     THE COURT:  Is the order finished? Is the peace bond done?

25     CLERK OF THE COURT:  Yes.

26     THE COURT:   Okay. I will sign it so he can get on his way.

27     MR. PENNEY:  I'll handle it — that's okay. Do you want to come forward, Mr. K. — just right here. Your Honour, the bond has been signed.

28     THE COURT:  Yes, thank you.

29     MR. PENNEY:  Ms Miller, the charge?

30     THE COURT:  The charge is withdrawn.

31     MS MILLER:  The charge may be withdrawn.

32     MR. PENNEY:  Thank you so much.
