Cyril's Case — Sexual Assault (child) — Police Report Client: Cyril, Accused Police Report — Part I: The first complainant attended Barrie Police to report allegations of historical sexual abuse and provided two videotaped statements. The following information was obtained. When the complainant was between the ages of seven and nine, the suspect, Cyril C., babysat him and his younger brother. Cyril C. was recommended to the complainant's parents by their neighbours. After the first few babysitting sessions, the suspect began sexually abusing the complainant, and continued until he was no longer employed. The abuse occurred at the complainant's home in the spare bedroom/laundry area. The complainant's younger brother was always sleeping upstairs during the abuse. The first time this occurred the suspect asked the complainant if he wanted to look at some pictures in a book, and then pulled out a pornographic magazine. The suspect asked the complainant about the naked men, asking questions such as who was better looking and who had the most appealing genitalia. This became the pattern for the assaults. Each time, the suspect began by showing the complainant pornographic magazines or videos and asked questions about the men. He would then begin fondling himself and/or the complainant, and eventually progressed to performing fellatio on the complainant and having the complainant perform fellatio on him. On two occasions, the suspect attempted anal penetration on the complainant. The complainant indicated he was "directed" by the suspect in terms of what to do and how to do it. Two of the strongest memories include the suspect masturbating in front of the complainant, and then ejaculating on the complainant's chest and stomach. The other is when the suspect undressed the complainant, made him kneel on his hands and knees on the bed, and then tried to enter him anally. The suspect always told the complainant it was their "little secret" and not to tell anyone. The complainant never did, and never confronted the suspect. In September 2001, the complainant realized he had to deal with this issue, as it was affecting his life, and had for many years. He disclosed to his parents and then to police. As a result of the investigation, a second complainant has come forward with similar allegations. It is believed the suspect is living in Toronto and that charges are forthcoming. Police Report — Part II: On the 10th of October 2001, the writer contacted the accused in this matter, Cyril C., and advised him of the investigation and impending charges. Arrangements were made for Cyril C. to meet the writer on the 11th of October at 52 Division of Toronto Police Service. On the 11th of October, the writer and Detective Constable H*** attended 52 Division and met the accused, Cyril C., whose identity was confirmed by an Ontario driver's license. He was arrested and given his Rights to counsel and cautions. He expressed an interest in speaking with duty counsel and the call was placed. The accused spoke with duty counsel and then had further conversation with the writer. He declined to provide a statement at that time. He was released on a promise to appear and undertaking, with a Court date of November 13th, 2001. It was explained to the accused that because the offences occurred when he was under the age of eighteen, he was being charged as a young offender, and is to appear in young offender Court. The accused was then turned over to Detective N*** of Toronto Police Service, as a warrant for his arrest was outstanding. The accused had been made aware of this by the writer on the 10th of October. The two victims in this matter were contacted by the writer on the 11th of October and advised of the arrest and charges. |
