Chester's Case — Driving Offences — Police Report

Client:  Chester C., Accused
Complainant:  Toronto Police Force, 11 Division

Charges:  (i) fail to remain at scene of accident, (ii) fail to report accident, and (iii) careless driving, contrary to the Highway Traffic Act; and (iv) operate motor vehicle without insurance and (v) make false insurance statement, contrary to the Compulsory Automobile Insurance Act

Police Report:  The Accused is the registered owner of vehicle licence number RTM 385. During 1999, the Accused attended at a Ministry of Transportation office situated in the City of Toronto. The Accused made an application on a Ministry of Transportation form and signed a certificate of insurance stating that the above motor vehicle was insured. The Accused, in fact, was not insured and made a false statement to obtain validation for the licence plate RTM 385. The reporting Officer was conducting another investigation in regards to the Accused when the above information was received.

On the 9th of December 2000, at approximately 1:45 p.m., the Accused before the Courts was operating a Ford motor vehicle, licence number RTM 385, south on Parkside Drive in the City of Toronto. The driver was involved in a motor vehicle collision and fled the scene. The reporting Officer interviewed the Accused the following day, at which the Accused readily admitted that he was the owner of the above vehicle and that there has not been insurance on the vehicle for several years.

On the 9th of December 2000, at approximately 1:45 p.m., the Accused before the Courts was operating a Ford motor vehicle, licence number RTM 385, south on Parkside Drive in the City of Toronto. The Accused lost control of his vehicle and rear-ended a stopped automobile. The Accused then immediately reversed and collided with another vehicle. The Accused then quickly pulled into the curb lane and struck a third vehicle. The damage to the Accused's car was to the front end, approximately $1,000, and the damage to the two other vehicles was in excess of $1,200.

The driver of the vehicle that was rear-ended was transported to St. Joseph Hospital by ambulance for treatment. The Accused fled the scene, south on Parkside Drive, and east on Lakeshore Boulevard West. The Accused made no attempt to stop and leave his name, address, phone number, and insurance particulars.

The reporting Officer arrived on the scene of the accident moments after the collision and spoke to the witnesses. The Officer conducted a search of the area in an attempt to locate the Accused. The Accused was not to be found.

The reporting Officer continued the investigation the following day and finally located the Accused. The Accused was interviewed. The Accused readily admitted to the accident. The reporting officer would request that the Accused's driver license be suspended for one year.
