Withdrawn — Sexual Assault — Police ReportClient: Charlie
F., Accused Police Report: On Saturday, the 20th of September 1997, plainclothes Officers from 42 Division' s Community Response Unit were on patrol in a plainclothes capacity in Morningside Park. Morningside Park is situated at 400 Morningside Avenue in the city of Scarborough. The Park has numerous complaints of sexual activity being conducted in plain view in the bathrooms and on the pathways. Police Constable B**** was in the park walking on a pathway between the 2nd and 3rd parking lots when he was approached by the Accused. The time was approximately 6:35 p.m. The Officer and the Accused engaged in trivial conversation, exchanging names and how both came to hear about the park and its activities. As Police Constable B**** looked away to spot his back-up Officer, the Accused leaned forward and put the palm of his right hand on the fly of Police Constable B****’s jeans. The Accused ran his right hand down the front of the Officer’s jeans and then cupped the Officer’s testicles in his right hand and stated: "Do you want to have some fun." Police Constable B**** retrieved his wallet badge, identified himself as a Police Officer, and advised the Accused that he was going to be charged with Sexual Assault. The Accused was taken out and placed in the rear of Sergeant C****’s vehicle, who was the back-up Officer. The Accused identified himself as Charlie F. (DOB: 5*-02-1*5). The Accused met the requirements of the Bail Reform Act and was subsequently released on a Form 9 Appearance Notice. |
