Carlo's Case — Assault (Domestic) — Withdrawn

Client:  Carlo E., Accused
Complainant:  Priti M., his spouse
Charge:  assault (domestic)

Background:  Carlo's daughter was scheduled for surgery in Toronto, and she wanted her dad by her side. But he was in Saudi Arabia, with an arrest warrant waiting for him in Toronto. Two years earlier Carlo's wife had complained of an assault, and Carlo had fled the country. If he flew back to Toronto now, he would likely be arrested on arrival.

Goals:  Carlo wanted me to arrange for him to return home without being arrested, and, if possible, to finish up the case.

Strategy:  I first contacted the Court Clerk. They confirmed that a warrant for Carlo's arrest had been issued on 28 December 2005. Then I contacted the Crown to determine if the warranted could be rescinded before Carlo's return.

Results:  Through negotiations, the Crown agreed that the community no longer had an interest in prosecuting Carlo. With Carlo still in Saudi Arabia, I attended Court to have the warrant cancelled and the charge withdrawn. A week later Carlo was with his daughter.
