¶ 1 THE COURT: The K. matter is a Peace Bond? ¶ 2 MS. PENNEY: Yes, Your Honour. That's — we had a judicial pre-trial on the last date with Ms Boyd. ¶ 3 THE COURT: Is it — where is K.? ¶ 4 MR. PENNEY: Mr. K., come forward, please.
The bond is sworn. ¶ 7 THE COURT: I'm
sure you did. ¶ 8 MR. LEISHMAN: Is this a brief from the nine o'clock list? ¶ 9 MR. PENNEY: Ten o'clock list, 53 to 56 ¶ 10 MR. LEISHMAN: What's the last name? ¶ 11 MR. PENNEY: K., K-*-*-*-* ¶ 12 COURT REPORTER: And your name, sir? ¶ 13 MR. PENNEY: My name is Penney P-E-N-N-E-Y, initial C., Mr. K. is before the Court right here. If we can, Your Honour, we'll waive the arraignment — ¶ 14 THE COURT: Okay, just a second, hold on. ¶ 15 MR. PENNEY: And we'll... ¶ 16 THE COURT: Is that
with a C or a K? ¶ 18 THE COURT: There it is. This is K. starting at 53, the bond is at 56. May I see the Bond please? ¶ 19 MR. PENNEY: It's within time, Your Honour. ¶ 20 THE COURT: Okay. It was sworn October 11th. Okay? Okay Mr. Leishman? ¶ 21 MR. LEISHMAN: Yes. ¶ 22 THE COURT: Alright, usual terms? Is there any need for contact, Mr. Penney? ¶ 23 MR. PENNEY: None, Your Honour. I'm waiving the reading of the election. He... ¶ 24 THE COURT: Okay. ¶ 25 MR. PENNEY: ...doesn't wish to show
cause. We're admitting, Your Honour, that there's reasonable grounds for
you to make the Order. ¶ 27 MR. LEISHMAN: ...Twelve months... ¶ 28 THE COURT: Thank you. Five hundred dollars, twelve months without surety or deposit, keep the peace, be of good behaviour, no contact with Colin U. Is that it? ¶ 29 MR. PENNEY: Yes. The person named in the Information. ¶ 30 MR. LEISHMAN: Is there to be a no weapons condition? This is a matter that was pre-tried before Your Honour back in September with my colleague, Ms Boyd, and I'm just trying to determine whether that was considered. ¶ 31 MR. PENNEY: We didn't specifically
discuss that, Your Honour, these... ¶ 33 MR. PENNEY: I have no — I have
no objection. ¶ 35 THE COURT: Okay. Possess no weapons. Okay, once that is — was there a trial date set, counsel? ¶ 36 MR. PENNEY: No, Your Honour. ¶ 37 THE COURT: Okay, once the bond is signed, I guess the Crown's asking the charge be withdrawn? ¶ 38 MR. LEISHMAN: Well, I should say for
the record, Your Honour knows this having pre-tried it, this is not a
matter that normally is resolved by way of an 810 but there was particular
circumstances that Ms Boyd was allotted to... ¶ 40 THE COURT: Okay ¶ 42 MR. PENNEY: Well, Your... ¶ 43 THE COURT: Okay. Fair enough. And I'm sure Mr. K. never wants to come back before the Court again. ¶ 44 MR. PENNEY: Yes. I'd — I'd ask my friend, since we're close to shutting down, just to withdraw the charges. The Bond is ordered, if he doesn't sign it, Your Honour can — ¶ 45 THE COURT: Yeah. I was just about to say, once it's signed, is it okay for the Clerk to withdraw, Mr. Leishman? ¶ 45 MR. LEISHMAN: That's correct, yes. ¶ 46 THE COURT: Okay, done. ¶ 47 MR. PENNEY: And I'm giving Mr. Leishman
back two DVD's and the two audio tapes pursuant to my undertaking. ¶ 50 MR. PENNEY: Thank you. |
