Borat's Case — Speeding & Fail to Stop — Police Report Client: Borat, Accused Police Report: On the 23rd of June, 2005, at approximately 8:45 a.m., Police Constable Flintstone of the O.P.P. was on routine patrol on Highway 407 eastbound in the area of Highway 27, City of Vaughan, Regional Municipality of York, Ontario. At this time, the officer was driving a fully marked O.P.P. police vehicle eastbound in lane #3. The Officer had occasion to look in his passenger side mirror and observed a red motorcycle approaching eastbound quickly from the rear very fast in lane #4. The vehicle appeared to be travelling far in excess of the 100 km/hr posted maximum speed limit. The motorcycle pulled past the officer on the right side and slowed quickly. It remained at the same speed as the police vehicle for a very short time and then began to accelerate and pull away. As the officer attempted to catch up over the next few seconds, the motorcycle quickly pulled away, using all lanes of the eastbound Highway 407, passing all other traffic very fast to their left and right. Over the next several kilometres, the officer attempted to catch up to the motorcycle with limited success. After passing highway 400 the officer activated his cruiser siren and emergency lights in an effort to close the distance between the cruiser and the motorcycle. Just west of Bathurst Street, the officer caught up to the motorcycle, now in lane #1, which suddenly cut over to lane #3 and accelerated quickly. The officer maintained a patrol speed of 160 km/hr directly behind the motorcycle in lane #3 and it continued to pull away as it proceeded eastbound. A short distance later, the motorcycle got caught up in traffic and was forced to slow down. P.C. Flintstone pulled into lane #2 directly beside the motorcycle that was currently in lane #1. The officer still had all the emergency lights activated, and when directly parallel to the motorcycle, sounded the cruiser's air horn. At this point, the distance between the two vehicles was approximately three feet. The male operator of the motorcycle looked over at P.C. Flintstone, looked away, and immediately turned and looked a second time at the officer. Immediately, the motorcycle began to accelerate along the intermittent line between lanes #1 and #2 and between other eastbound vehicles. The motorcycle continued eastbound weaving through eastbound traffic using all lanes and changing lanes very close to other vehicles. P.C. Flintstone moved to the right paved shoulder and followed the eastbound motorcycle with his emergency lights and siren still activated. Just east of Yonge Street, a construction zone commenced and all driving lanes of traffic slowed drastically with the left shoulder ending on the left side of the highway and a cement barrier extending eastbound along the left shoulder. At this point, P.C. Flintstone was able to catch up to the eastbound lane #1 in an effort to squeeze the motorcycle towards the cement barrier and prevent it from further escape. P.C. Flintstone yelled at the operator and the motorcycle pulled to the right shoulder and stopped. The male driver of the motorcycle properly identified himself to P.C. Flintstone with a valid Ontario Driver's Licence as Borat A. with an address of 17 Fig Street, Brampton, Ontario. The vehicle being operated was a red Aprilia motorcycle bearing plate RT385. Following his conversation with the driver, P.C. Flintstone issued Part III summons on the driver. The driver was also warned for dangerous driving. |
