Basil's Case — Sexual Assault — Police Report Client: Basil, Accused Police Report: The victim is a member of a Scarborough Recreational Group and routinely visits the facility 3-4 times per week. The victim is a pastor for a society. On Monday, the 22nd of October 2001, the victim attended the facility at about 7:20 p.m. He spent his time in the swimming pool and then went to the showers at about 7:50 p.m. The accused entered the shower while the victim was also showering. The victim became aware that the accused was watching him, but did not make any eye contact with him. The accused watching him made the victim so uncomfortable that the victim made a point of looking the other way as he exited the shower. The victim followed his regular routine of going to the sauna to dry off because of the heat. He went to his normal spot in the sauna, which was against the wall between the heater and the seats. The victim began drying himself off. The accused followed him into the sauna. He walked up to the victim and reached out and touched the victims penis. The victim immediately pushed him away and confronted him regarding his actions. The accused replied: I was just trying to get by. The victim stated there was nowhere for the accused to go as he was against the wall. The victim was very upset by the actions of the accused and immediately reported the assault to staff. Staff attended the change rooms with the victim at which time the accused was found to be in the showers again. Police were called. The suspect was arrested and transported to 41 Division where he was charged accordingly. The victim provided a videotaped statement to police. |
