Austin's Case — Assault (domestic) — Police Report

Police Report:   On December 18, 2000 at 2207 hrs, P.C. E*** and P.C. M*** received a radio call to attend the above mentioned address for unknown trouble, possible domestic dispute.

Officers arrived on scene. A male party met them at the front door. The officers spoke to the female while P.C. B*** spoke to the male.

The female advised that she came home from shopping. She was making dinner for their children as they had to take medication. The couple began arguing about what their son was going to wear for Christmas. The male then told the female to make him tea. The female told him she was going to make the children's dinner first. The male became very angry. He put their son down and charged toward the female. He kicked the fridge closed and punched her in her right cheek. The female then went into the living room. The male followed her. The female advised officers that she knew he was going to hit her again.

The female then phoned 9-1-1. The male grabbed the female by her hair and started to pull her back. He was trying to prevent her from calling the police.

The victim stated to officers that this is not the first time that the male has hit her. This is the first time that she has phoned the police.

The victim was visibly upset, especially due to the fact that her 5-year-old daughter and their younger son witnessed the whole incident. The victim expressed concerns that the male may come after her again. The victim was informed that she was to contact police (phone 9-1-1) if the accused contacted her or came to her house.

The accused was arrested at 2220 hrs by P.C. E***. The officers turned him over to P.C. B*** to transport to 17 Division. P.C. E*** and P.C. M*** took a victim statement. P.C. W*** attended the residence for pictures.

Victim's Injuries:  
- scratch on right cheek
- cut on lower left lip
- bump on back of head

Copy [of pictures] faxed to victims of crime and to Children's Aid Society.

P.C. B*** read the accused rights to counsel and cautioned him as well as transported him to 17 Division.

Accused had a scratch on his face, sustained while he was pulling the victim's hair. Victim did this in self-defence.
