April's Case — Assault (Domestic) — Police Report Client: April, Complainant Police Report: On the 25th of October 2006, police attended 8 Caramel Road in the city of Vaughan to investigate a domestic incident. Police received a 911 call where the female, April W., contacted police claiming that her husband had, "put his elbow on her neck." Police arrived on scene and were greeted by her husband Nate G. who appeared upset. He told police that his wife was upstairs in the bedroom. Nate told police that his wife and his were arguing and she wanted to leave the residence with her wedding ring and engagement ring. She went upstairs to get the rings from the bedside table when he followed her and attempted to get the rings before she did. She was able to get the rings and he attempted to take them away from her. He told police that they were going back and forth trying to take the rings from each other. And then she contacted police. Police went upstairs and spoke with the wife, who was crying and visibly upset. She told police the same events, however, indicated that when she had the rings in her hand, her husband, with his right forearm, held her by the throat against the wall. With his left hand, he attempted to hold her right hand behind her back. She also told police that with her left hand, she attempted to grab her husband by the back of his shirt to attempt to get him to let go. During this altercation, according to April, she was able to free her right hand and was able to punch Nate in the midsection to get him to let go of her. She said that this did not effect him so she grabbed him in the "balls." She told police that this made Nate release the pressure he was putting on her throat but he continued to hold her against the wall. He then kneed her to her midsection so she would not attempt to kick him. During this altercation they were both yelling at each other about the rings and who they belong to. At some point, according to April, Nate released her and was going to go for the phone to call her aunt. As he released her, April also went for the phone to call police. Nate then threw April to the bed and held her face down as he pulled her hair. At this point, April, holding the handheld phone, was able to call 911. She said that once Nate realized she had called police, he let her go and began to yell: "She attacked me!" Based on the information provided, Nate was arrested by Police Constable W*** and was transported to 4 District to be held for a show-cause hearing. The accused was booked by Staff Sergeant M*** and placed into interview room #2. The accused spoke with duty counsel and was then put into cell #3. When speaking with the accused, he showed the arresting officer two marks on his inner biceps. (One bite mark on each bicep in the same position.) He told police that his wife had bit him at least 6 months ago and these were the marks from those two incidents. Police questioned the victim about these marks on her husband and she explained that one time in the winter of 2006, her husband had come up behind her during an argument while she was ironing and he put his arm around her throat as if to choke her and he held her tight. She explained that she bit him in the forearm to get him to release his hold on her. She also explained that the similar bite on his opposite arm was from a few months after the first time (in the spring of 2006), when again, during another argument, he put his arm around her throat again, and once again held her tight. She told police that she did bite him again to get him to let go of her. The victim, during the sworn video statement, also told police that she had called police once before in 2004 because Nate (her boyfriend at that time) slapped her in the face during an argument and chased her around the house attempting to hit her again. She said that once police arrived, she felt sorry for Nate and told them that nothing physical happened. Police investigated the incident, and, based on what both parties told police, there was no corroborating evidence of an assault. Based on the information provided by the victim, Nate G. is being charged with 4 counts of assault. |
