¶ 1 MS SILVER: Aldo N., line 22. ¶ 2 MR. PENNEY: Good morning, Your Honour. This is Mr. Aldo N. The complainant is in the body of the Court. ¶ 3 THE COURT: What does he wish to do? ¶ 4 MS SILVER: We placed a new Information, a section- 810 Information before the Court. ¶ 5 THE COURT: Fine. Your client understands what that's all about, does he? ¶ 6 MR. PENNEY: Yes sir. P-E-N-N-E-Y, initial C. And we do not wish to show case. We do not need him to be arraigned on the Information. ¶ 7 THE COURT: Fine, and what terms did you want? ¶ 8 MS SILVER: One year, five hundred dollars, no deposit, no surety. Not to have any contact directly or indirectly ... ¶ 9 THE COURT: With Mary N. like it says on the Information here? ¶ 10 MS SILVER: Yes ... ¶ 11 THE COURT: Okay. ¶ 12 MS SILVER: ... except with her prior written revocable consent filed with Detective P*** W., badge 1**4, 56 Division or his designate ... ¶ 13 MR. PENNEY: The only problem, Your Honour, is they have been together since July the 8th. They are in the body of the Court today. This means they cannot leave the building together ... ¶ 14 THE COURT: Yes, I can give them permission to leave the building ... ¶ 15 MR. PENNEY: Unless my friend is agreeing that the consent already filed with the officer is sufficient consent for this purpose as well. ¶ 16 MS SILVER: Yes, it is. ¶ 17 THE COURT: Fine ... ¶ 18 MR. PENNEY: In that case, she only needs ... ¶ 19 MS SILVER: She is present in Court today? ¶ 20 MR. PENNEY: Yes, she is present in Court today, so Ms Mary N. if you want to revoke your consent, you can file a new one with the officer in charge, but for now your existing consent is fine. ¶ 21 THE COURT: Okay, thank you. ¶ 22 MR. PENNEY: All right. ¶ 23 MS SILVER: And also not to possess any weapons ... ¶ 24 THE COURT: No weapons ... ¶ 25 MS SILVER: ... as defined by the Criminal Code. ¶ 26 THE COURT: ... a good idea. No weapons. One year, you say? ¶ 27 MS SILVER: Yes. ¶ 28 THE COURT: Okay, we are going to write up the paper and then the actual charge will be withdrawn, okay. It will take a few minutes. ¶ 29 MR. PENNEY: He will have a seat, Your Honour, thank you. ¶ 30 THE COURT: Thank you. |
