Aldo's Case — Assault & Threat (Domestic) — Withdrawn Client: Aldo N., Accused Background: Things got heated again for Aldo and his wife Mary. This time Mary called the police. She alleged that Aldo had twice assaulted her and had threatened to kill her. Aldo was arrested, charged, and banned from going home. Goals: Aldo wanted to avoid a criminal record and reconcile with his wife. Strategy: Aldo immediately enrolled in counselling. We scheduled a trial as soon as we could. Our defence was that Aldo did not commit these crimes. Aldo was prepared to testify at trial. Results: At the trial months later, I presented the Crown with a report from a counsellor. The counsellor explained how Aldo was gaining an understanding into the "why" of what happened. The Crown and I decided not to have a trial. Instead, the bail conditions were varied to allow Aldo to go home, and Aldo agreed to further counselling. When we returned to Court again, Aldo agreed to a Recognizance to keep the peace and be of good behaviour. The Crown withdrew all charges. READ THE TRANSCRIPT REGARDING THE PEACE BOND |
